Terms of Service and Cancellation Policy

1. Cancellation/Reschedule: Requests to cancel or reschedule a booked session will be honored free of charge if received 48 hours in advance of a scheduled session. Cancellation/reschedule requests submitted within 48 hours of the scheduled start of the booked session will be subject to a cancellation fee equal to half of the deposit. Cancellation/reschedule requests submitted within 24 hours of the scheduled start of the booked session will be subject to a cancellation fee equal to the deposit. Under extenuating circumstances, ie. death in the family, injury/illness, etc., Black Dog Recording will review and appropriately reimburse client deposit.

 

 

2. Damages:

 

A. Client shall be held responsible for any damages done to the property of Black Dog Recording, its affiliated members, and/or injuries of any of its members, contractors, or associates during the duration of the project by the client or anyone the client brings into Black Dog Recording. The property covered in this agreement includes but is not limited to recording equipment, recording location, computer data, and other physical items present at the location of the project. Client agrees to financially reimburse Black Dog Recording in a prompt fashion should any of the aforementioned damage or injury occur. 

B. Client agrees to release Black Dog Recording and any of its affiliated members from harm or damage that may occur to any person in the Client's party or equipment belonging to the client, unless that damage is due to the direct fault or negligence of Black Dog Recording or its affiliated members.

3. Surveillance: Black Dog Recording houses and maintains valuable equipment and property.  To mitigate unknown damage and/or theft of property, Black Dog Recording reserves the right to take and maintain data of surveillance video and audio at its facilities.

4. Release of Material: Any material recorded, produced, mixed, or mastered at Black Dog Recording will be released to the Client upon payment of the fee balance, unless otherwise arranged between the parties.

 

 

5. Ownership:

A. Client shall be responsible to obtain proper copyrights for his/her music.

B. Black Dog Recording shall maintain any of Client’s recorded material on Black Dog Recording’s hard drive for a minimum of one year after the date of the recorded material.

C. Except as otherwise provided in a separate project agreement, the Client shall retain all ownership and rights to the recorded material once payment has been received in full.


 

6. Miscellaneous: Should any portion of this Agreement prove to be invalid, illegal, or unenforceable, it shall not affect the remainder of this Agreement. This Agreement is governed by the laws of the State of Tennessee. In the event of a disagreement between the parties regarding the performance of this Agreement, both parties agree to attempt first a resolution through mediation. Should mediation fail and should litigation arise between the parties, the prevailing party shall be compensated for whatever damages are awarded, plus reasonable attorney's fees, by the other party.
